Chapter 6.12 DISCHARGE REQUIREMENTS AND REGULATIONS |
§ 6.12.030. Compliance time schedule.
If the General Manager determines that an existing User must install additional pretreatment equipment and/or wastewater monitoring and control devices to comply with this Title, the General Manager may approve the User's request to submit a Compliance Time Schedule [CTS] to achieve compliance. [An existing User would be one currently engaged in business operations and currently discharging wastewater to the District sewer.] An acceptable CTS shall be the shortest schedule by which the user will provide such additional devices and corrective actions. The General Manager may allow a User with an approved CTS to continue business operations and sewer discharge during execution of the CTS. The following conditions shall apply to such a schedule:
A.
The CTS shall contain increments of progress in the form of dates for the commencement and completion of major events leading to the construction and operation of additional pretreatment and/or controls required for the User to achieve compliance (e.g., hiring an engineer, completing preliminary plans, completing final plans, executing contract for major components, commencing construction, completing construction, etc.);
B.
No increment referred to in Section 6.12.030(A) shall exceed nine months. The total time for the CTS shall not exceed eighteen (18) months unless approved by the General Manager;
C.
Not later than fourteen (14) calendar days following each date in the CTS and the final date for compliance, the User shall submit a progress report to the General Manager including, as a minimum, whether or not the User complied with the increment of progress to be met on such date and, if not, the date on which the User expects to comply with this increment of progress, the reason for delay, and the steps being taken by the User to return the construction to the established schedule. In no event shall more than nine months elapse between such progress reports to the General Manager.
