§ 3.04.020. Policy.

  • It is the District's policy to respond to claims promptly and fairly. The District evaluates each claim on a case-by-case basis based on its investigation and the information provided by the claimant in a timely submitted Standard Tort Claim form, which form is provided by the District.

    The California Tort Claims Act (commencing with section 900) of the California Government Code governs the manner in which a public entity must handle claims for money or damages filed against it. All claims against the District, including claims for money and damages which are excepted by Section 905 from Chapter 1 (commencing with Section 900) and Chapter 2 (commencing with Section 910) of the Government Code and which are not governed by any other statutes or regulations expressly relating thereto, shall be governed by this Standard Tort Claim Policy and the procedure set forth herein in accordance with the provisions of Government Code section 935.

    This Standard Tort Claim Policy does not supersede, replace or modify any of the requirements for claim submission and processing or the limitations periods therefore provided in Government Code section 905 et seq.
